The record

Chief of the Air Quality Bureau at the New Mexico Environment Department — the bureau that received the YGI Microgrid application on April 27, 2026 and ruled it complete a month later. On July 1, 2026 she wrote to Cabinet Secretary James Kenney, through Division Director Michelle Miano, recommending that a public hearing be held.

Her stated grounds were the volume of comment and "significant public interest" under 20.2.72.206 NMAC. Kenney checked "I concur" and signed it by DocuSign the same day; the docket opened the next day. The hearing that has since been scheduled, accelerated, fought over, stayed and left unheld exists because a bureau chief asked for it and a cabinet secretary said yes.

The hearing has passed
The Watch stands.

The decision was due July 21. Instead: a public hearing — first set for October, then moved up to September 14 at the applicant’s request — and a ruling due by November 23. A $165B question for one desert county, on a schedule that keeps moving. The clock above always shows the next date that matters. Until the ruling, and after, this is the public watch on how it’s being made.
